GENERAL SALES TERMS AND CONDITIONS

The following sales conditions, in accordance with the applicable directives of Legislative Decree 206/2005 (“Consumer Code”), pursuant to Article 50, are applied on purchases made directly on New Ball SRL’s site (https://www.newball.it/home/).

This website is managed by New Ball S.r.l., with registered office in Via Balossa, 25, P.C.20032 – Cormano, Milan, Italy. Fiscal Code, VAT number and registration number in the Commercial Register of Milano/Monza Brianza/Lodi: 10566500962, REA Number: MI – 2542241.

Sales terms and conditions can be changed by New Ball SRL specifying the new effective date on the website www.newball.it.  Any change to the sales conditions will apply to purchases placed starting from the effective date included, as long as modified sales terms are visible on the website as applicable conditions when ordering.

PRICES

Sales prices are vat included. Delivery costs will be calculated automatically in the final phase of the order considering your delivery address and weight/size of the package.

PURCHASE AND PAYMENT METHODS

To complete your order, it is necessary to:

  • Provide your name/company name and address, phone number, e-mail address, payment details, fiscal code/VAT number and other information required;
  • Provide a valid delivery address.

When the order will be officially placed, the customer will receive an order confirmation by e-mail.

Customer will be required to select one of the following payment methods:

  • Paypal
  • Bank Transfer

DELIVERY

  • Delivery time is in about 2-3 working days for deliveries in peninsular Italy; 5-6 working days for deliveries in Italian islands and 5-8 working days for deliveries in foreign countries.

 

  • Possibility to collect the goods at our warehouse after asking directly to New Ball SRL, in this case delivery costs will not be required.

 

Any particular request about delivery method has to be discussed and approved by phone before placing the order online.

New Ball SRL will not be considered responsible for delays or lack of delivery if they are caused by circumstances not depending on his will, such as outbreak of wars, requisition of troops, strikes and lock-out, breaking of machinery, fires, stoppage of transportation means, difficulties in supplying raw materials or energy, whatever restrictions or prohibitions imposed upon by the Public Authorities.

PRODUCT AVAILABILITY

If the item the customer intends to order is not available from stock, it should be technically impossible for the customer to proceed with the order online. If it occurs that the item ordered is no longer available from stock, New Ball SRL will promptly inform the customer and will eventually refund the paid amount if the customer does not intend to change item or wait for restock.

WARRANTY AND ASSISTANCE

For any purchased product, New Ball SRL rules are applicable, together with guarantees and assistance as per sale conditions.

CUSTOMER’S OBLIGATION

The customer declares and guarantees, under its own responsibility, to be a consumer in accordance with art.3 of the Consumer Code and that the personal data supplied are correct and truthful.

New Ball SRL cannot guarantee that the products ordered are suitable for the customer’s application if not previously stated with our technical department.

RIGHT OF WITHDRAWAL

The right of withdrawal can only be applied to contracts between New ball SRL and the final consumer. It can be exercised within 14 days from the order and without penalty or specific cause, sending a written communication by registered letter with acknowledgment of receipt or by certified electronic mail PEC.

The customer who intends to make use of the right of withdrawal must send the items back to our office within a week from the withdrawal, according to our conditions. The right of withdrawal will not apply to:

. items realized according to request/drawing of the customer

. items which have been used or could damage during the shipment

Return costs are at customer’s charge. New Ball SRL will check the goods and, after verifying that the items are not damaged or used, will proceed with the refund of the total amount of the order, shipping costs excluded.

Users are asked to consult privacy policy to get information on the collection and processing of personal data

APPLICABLE LAW

Sales conditions and purchases made on our website www.newball.it are governed by Italian law. Any dispute will be subject to the exclusive jurisdiction of the Court of Milan.
